Official Contest Rules
NO PURCHASE IS NECESSARY TO ENTER TO WIN THIS SWEEPSTAKES. A PURCHASE OR PAYMENT WILL NOT INCREASE OR IMPROVE CHANCES OF WINNING.
Sweepstakes Description: The Tailscale Moonlander Sweepstakes described at https://tailscale.com/gophercon23/ (the “Sweepstakes’’) is being sponsored by Tailscale Inc. (“Tailscale”). Tailscale invites eligible individuals (“Entrants”) who attended GopherCon 2023 (the “Event”) to submit an entry to the Sweepstakes. One winner will be selected in a random drawing for each 10 eligible entries received. The Sweepstakes is subject to all applicable laws and regulations and is void where prohibited.
Sweepstakes Period: The Sweepstakes entry period begins on Wednesday, September 27, 2023 at 9:00 a.m. PT and ends Friday, October 27, 2023, at 11:59 p.m. PT (the “Sweepstakes Period”). Tailscale’s clock is the official clock and sole determinant for the purposes of a valid submission in the Sweepstakes.
Eligibility: The Sweepstakes is only open to legal residents of Canada, excluding Quebec, the United States, and the District of Columbia (excluding Puerto Rico) who are 18 years of age or older (or the age of majority in their state or country of residence, whichever is older). The Sweepstakes is not open to any employee of a current Tailscale customer, any employee of a Tailscale competitor, or any agent or employee of Tailscale or its affiliates or marketing firms, or to any immediate family or household member of those individuals.
How to Enter: Visit the URL referenced above during the Sweepstakes period and follow the instructions for Sweepstakes entry, which includes (i) completing the form located at https://tailscale.com/gophercon23 — entries submitted through completion of the Instructions must be received by Tailscale during the Sweepstakes period.
For an entrant to be entered into the Sweepstakes, the Entrant must complete all Directions outlined. Entrants understand that submitting an entry does not mean they will win the Sweepstakes. Incomplete entries will be disqualified. All entries submitted become the property of Tailscale and will not be returned. All Entrants are permitted to submit one entry into the Sweepstakes. Entries will not be accepted if no valid email address is provided, if the supplied email address is not current or if the first and last name are not provided. In the event of a dispute as to the identity of the Entrant, the authorized account holder of the email address used to enter will be deemed to the Entrant. Potential winners may be required to show proof of being the authorized account holder. The “authorized account holder” is the natural person assigned to an email address by an Internet service provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
Drawing; Odds: Notification: On Friday, October 27, 2023, at the ratio of 1 winner per every 10 Entrants (each a “Prize Winner”), rounded to the lowest interval of 10 Entrants (i.e. 53 Entrants will produce 5 Prize Winners). Prize Winners will be selected in a random drawing from among all eligible entries received. The random drawing will be conducted and the Prize Winners will be announced via email by Friday, November 3, 2023. All Entrants are solely responsible for ensuring they include (along with their entry) valid and current contact information. Returned or undeliverable notifications may result in forfeiture of the prize. Canadian residents must correctly answer a mathematical skill testing question to win; an incorrect answer will result in forfeiture of the prize. Where not prohibited by law, the Prize Winners may be required to execute and return to Tailscale a notarized affidavit of eligibility (the “Affidavit”), a liability release, and a publicity release relating to the prize within 7 business days of attempted prize notification in order to claim the prize, or the prize may be forfeited. All forfeited prizes may be awarded to an alternate winner selected in a random drawing from among the remaining Entrants. The Affidavit must be in the form Tailscale provided.
Prizes and Approximate Retail Value: Winners will receive one Moonlander Keyboard, with an approximate retail value of $365. Actual/appraised value may differ at time the prize is awarded. The specifics of the prize shall be solely determined by the Tailscale. No cash or other prize substitution is permitted. The prize is non-transferable. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Delivery of the prize may take up to 6 to 8 weeks from the date of receipt of the Prize Winner’s signed Affidavit.
Agreement to Official Rules: By submitting an entry, Entrants fully and unconditionally agree to abide by and be bound by the terms and conditions of these Official Rules and decisions by Tailscale, which decisions shall be final and binding on all matters pertaining to the Sweepstakes, including without limitation decisions regarding eligibility, the selection of the Prize Winners, and the interpretation of these Official Rules.
General Conditions: Tailscale reserves the right to cancel, suspend, and/or modify the Sweepstakes, in whole or in part, due to any fraud, bugs, virus, technical failures, changes in the law, or any other factor beyond Tailscale’s reasonable control that impairs the integrity or proper functioning of the Sweepstakes, as determined by Tailscale. Tailscale reserves the right, in its sole discretion, to disqualify any individual tampering,or attempting to tamper, with the administration and/or operation of the Sweepstakes, including without limitations the entry process or the Prize Winner draw process. If Tailscale determines, in its sole discretion, that the integrity or viability of the Sweepstakes is compromised, Tailscale reserves the right to void any entry at issue and/or terminate the relevant portion of the Sweepstakes, including the entire Sweepstakes.
Warning: Persons who deliberately undermines, or attempts to undermine, the legitimate operation of the promotion will be disqualified and may be subject to criminal and civil prosecution and penalties. Should such an attempt be made, Tailscale reserves the right to seek damages from any such person to the fullest extent permitted by law. Tailscale’s failure to enforce any terms of these official rules shall not constitute a waiver of that provision.
Failure to Comply with Official Rules: Without limitation, a Prize Winner may be disqualified with any prize forfeited due to any of following reasons: (i) Prize Winner fails to comply with any of the terms and conditions, restrictions, or limitations of these Official Rules; (ii) the Prize Winner is found to be ineligible; (iii) the Prize Winner fails to respond to prize notification within three days after transmission or mailing, (iv) the return of two attempted email notifications as undeliverable; (v) the Prize Winner fails to respond to any other notice within three days after its transmission or mailing; (vi) the return of any other notice as undeliverable; (vii) the Prize Winner fails to complete, sign, have notarized, and return to Tailscale the Affidavit within 10 business days of attempted prize notification (if requested by Tailscale, except where prohibited by law), or (viii), for Canadian residents, the Prize Winner fails to correctly answer the mathematical skill testing question. In the event of disqualification of a Prize Winner, the prize will be forfeited and awarded to an alternate winner selected at random.
Indemnification: As a condition of entry, Entrants agree to release, indemnify, and hold harmless Tailscale, together with its affiliates and marketing firms, and their respective directors, officers, employees, shareholders, and agents, (collectively Tailscale Parties) from and against any and all claims, expenses, and liability, including but not limited to injury, death, loss or damages to Entrant or any person or entity, including without limitation damage to personal or real property, caused in whole or part, directly or indirectly, by reason of their participation in the Sweepstakes (or related activities), their acceptance, possession, or use/misuse of the prize, or from any delay in receiving any prize awarded. Entrants’ obligation to indemnify Tailscale include actions arising from (a) any allegation that any entry or any related content infringes or otherwise violates trademark, copyright or other intellectual property rights, or any rights of any third party, or (b) from any other violation of these Official Rules. By submitting an entry, Entrants agree that they have no right to bring any claim, action, or proceeding whatsoever against any Tailscale party in connection with the Sweepstakes. Entrants acknowledge and agree that no Tailscale party has now, or shall have in the future, any duty or liability, direct or indirect, with respect to the non-infringement or protection of any copyright, trademark, patent, or any other claimed right or interest in related content.
Limitation of Liability: Tailscale is not responsible and will have no obligation or liability resulting from: (a) Prize claims or Prize notifications that are lost, late, damaged, destroyed, stolen, incomplete, illegible, unintelligible, or otherwise not received by the intended recipient; (b) human or technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software or incorrect or incomplete information, whether caused by the Entrant, technical errors or by any of the equipment or programming associated with or utilized in the Sweepstakes or the processing of entries or; (d) unauthorized human intervention in any part of the entry process or the Sweepstakes. Entrants agree that any and all claims, judgements, and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorneys’ fees, and Entrants waive all rights to claim any punitive, incidental, consequential, and any other damages other than actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
Governing Law: Entrants agree that any and all disputes, claims, and causes of action arising out of or relating to this Sweepstakes or any prizes awarded shall be governed in all respects by the laws of the Province of Ontario and the federal laws of Canada applicable hereto, without regard to the conflicts of laws principles of any jurisdiction. Venue with respect to any such disputes shall be only in the courts of Toronto, Ontario.
Severability: If any provision(s) of these Official Rules are held to be invalid or unenforceable, the remaining provisions hereof shall remain in full force and effect.
Privacy: Information collected from Entrants will be used by Tailscale for the purpose of facilitating the sweepstakes and for other purposes subject to Tailscale’s privacy policy available at https://tailscale.com/privacy.
Winners List: To obtain the list of Prize Winners (available one month after the drawing), email a request for a copy of the Sweepstakes winners list with specificity as to associated event, to events@tailscale.com.
